Return Policy<\/strong>
\nFor product or products purchased (the \u201cProduct\u201d) directly from BodiMetrics\u2019 website\u00a0(www.bodimetrics.com), this return policy allows you to return the Product after obtaining an\u00a0BodiMetrics return material authorization (\u201cRMA\u201d) during the 30 day period following date of\u00a0shipment by BodiMetrics. If the item is returned in\u00a0its original condition, unused, and in the original\u00a0packaging in accordance with this policy, we will exchange it or offer a refund of the purchase price\u00a0paid, which refund will be made by crediting the account used to make the original purchase. The\u00a0RMA may be obtained by contacting our Customer Service department at\u00a0support@bodimetrics.comor by calling (844) 744-8800; option 2. The Product\u00a0must be received by BodiMetrics within 10 days\u00a0after issuance of the RMA.<\/p>\n

All Products must be packed in the original and unmarked packaging including any accessories,\u00a0manuals, documentation, and registration that shipped with the Product. The RMA number must be\u00a0included with the returned Product.<\/p>\n

Shipping and handling charges, gift wrap fees, and\u00a0taxes paid (e.g., state, customs, VAT) are not\u00a0refundable. You are responsible for and must prepay\u00a0all shipping charges and you shall assume all\u00a0risk of loss or damage to the Product while in transit to BodiMetrics. If you return the Product to\u00a0BodiMetrics (a) without a RMA, (b) beyond the 10 days RMA issuance period, or (c) without proper\u00a0packaging, BodiMetrics retains the right to either\u00a0refuse delivery of such return or charge you a\u00a0restocking fee. The time to credit your account may\u00a0vary, depending on processing time.<\/p>\n

365 Day Limited Warranty<\/strong>
\nBodiMetrics, LLC (\u201cBodiMetrics\u201d) warrants the BodiMetrics hardware (the \u201cProduct\u201d), and only the\u00a0Product, against defects in materials and workmanship under normal use for a period of one year\u00a0(365) days from the date of purchase by the original purchaser (\u201cWarranty Period\u201d). Under this\u00a0Limited Warranty, if a defect arises and a valid claim is received by BodiMetrics within the Warranty\u00a0Period regarding the Product, at its option and to\u00a0the extent permitted by law, BodiMetrics will either\u00a0(1) repair the Product, using new or refurbished replacement parts or (2) exchange the Product with\u00a0a new or refurbished Product. In the event of a defect, to the extent permitted by law, these are the\u00a0sole and exclusive remedies.<\/p>\n

The warranty for the replacement Product or part assumes the original Product or one-year (365)\u00a0days from the date of replacement or repair, whichever is longer.<\/p>\n

When a Product is exchanged, any replacement item becomes your property and the replaced item\u00a0becomes BodiMetrics\u2019 property.<\/p>\n

Product must be freight prepaid, in its original packaging to the specified address with furnish proofof purchase to receive warranty service. It is your\u00a0responsibility to backup any information, data, or\u00a0other items you may have stored on the Product. BodiMetrics will not be responsible for any such\u00a0damage or loss.<\/p>\n

Exclusions and Limitations<\/strong>.<\/strong>\u00a0This Limited Warranty applies only to the Product\u00a0manufactured by\u00a0or for BodiMetrics that can be identified by the \u201cBodiMetrics\u201d trademark, trade name, or logo affixed\u00a0to it. The Limited Warranty does not apply to any (a) BodiMetrics products and services other than\u00a0the Product, (b) non-BodiMetrics hardware product,\u00a0(c) consumables (such as batteries), or (d)\u00a0software, even if packaged or sold with the Product\u00a0or embedded in the Product. Refer to the licenses\u00a0accompanying the software for details of your rights with respect to its use.<\/p>\n

BodiMetrics does not warrant that the operation of\u00a0the Product will be uninterrupted or error-free.\u00a0BodiMetrics is not responsible for damage arising from failure to follow instructions relating to the\u00a0Product’s use. BodiMetrics is not responsible for\u00a0Product that has been altered or modified. Recoveryand reinstallation of software programs and user data are not covered under this Limited Warranty.<\/p>\n

This Limited Warranty does not cover the cost of returning the Product to BodiMetrics; this is your\u00a0responsibility.\u00a0No BodiMetrics reseller, agent, or employee is authorized to make any modification, extension, or\u00a0addition to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality orenforceability of the remaining terms shall not be\u00a0affected or impaired.<\/p>\n

Implied Warranties.<\/strong>\u00a0EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW,\u00a0ALL IMPLIED\u00a0WARRANTIES (INCLUDING WARRANTIES OF MERCHANTABILITY\u00a0AND FITNESS FOR A PARTICULAR\u00a0PURPOSE) SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY.<\/p>\n

Limitation of Damages.<\/strong>\u00a0EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW,\u00a0BodiMetrics\u00a0SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES\u00a0RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION, OR UNDER\u00a0ANY OTHER LEGAL THEORY.<\/p>\n

Consumer Protection.<\/strong>\u00a0Some states do not allow the exclusion or limitation of incidental or\u00a0consequential damages, or allow limitations on how\u00a0long an implied warranty lasts, so the above\u00a0limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and youmay also have other rights that vary by state to state.<\/p>\n

Governing Law and Arbitration.<\/strong>\u00a0This Limited Warranty shall be governed by the laws of the State\u00a0of California without giving effect to any conflict\u00a0of laws principles that may provide the application\u00a0of the law of another jurisdiction. Any claim or dispute in connection with this Limited Warranty shall\u00a0be resolved in a cost effective manner through binding non-appearance-based arbitration. The\u00a0arbitration shall be initiated through an established alternative dispute resolution provider mutuallyagreed upon by the parties. The alternative dispute\u00a0resolution provider and the parties must comply\u00a0with the following rules: a) the arbitration shall\u00a0be conducted by telephone, online and\/or be solely\u00a0based on written submissions, the specific manner shall be chosen by the party initiating the\u00a0arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses\u00a0unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the\u00a0arbitrator may be entered in any court of competent\u00a0jurisdiction. If the foregoing arbitration clause\u00a0does not apply for any reason, you agree to submit\u00a0to the personal jurisdiction of the state courts\u00a0located within Los Angeles County, California and the federal courts in the Southern District of\u00a0California for the purpose of litigating all such claims or disputes, which courts shall have exclusive\u00a0jurisdiction of such claims or disputes. Notwithstanding the foregoing, BodiMetrics may seek\u00a0injunctive or other equitable relief to protect its\u00a0intellectual property rights in any court of competent\u00a0jurisdiction.<\/p>\n
